Terms and Conditions

By placing an order with Concrete Shop LLC (“Company”), you (“Customer”) agree to these Terms & Conditions. Payment constitutes confirmation of this agreement.

1. Payment Terms
   •    Standard items: full payment due at order placement.
   •    Custom projects: 50 % deposit required; remaining balance due within 5 days after completion. 
   •    Company retains ownership until full payment is received.
   •    Accepted payment methods: Visa, MasterCard, Discover, American Express, Paypal, checks, and wire transfers. Orders via check or bank transfer begin processing once funds clear.

2. Customer Responsibilities
Customer shall respond promptly to Company requests for approvals, site access, information, and any required permits or licenses. Site must be prepared when Company arrives for installation or measurement.

3. Cancellations & Modifications
   •    Custom work: non-cancelable and non-refundable after start.
   •    Standard items: cancellable within 15 days with a restocking fee of 25%, plus return shipping.
   •    Changes after production begins may incur extra charges and require Company approval.

4. Approvals & Accuracy
Customer must approve all drawings, mockups, or templates in writing prior to production. Company is not liable for inaccuracies not reported before manufacturing.

5. Shipping & Delivery
   •    Company will coordinate shipments via Fedex/UPS or similar.
   •    Customer must inspect delivery and note any visible damage before signing.
   •    Product must be inspected within [48] hours of receipt and any damage or shortage reported in writing.
   •    Company is not liable for issues reported after this period.

6. Additional Charges
Applicable storage fees, overtime charges, or late payment interest 2% per month) may apply to delayed pickups, extended deadlines, or delayed payments.

7. Sales Tax
Sales tax will be collected based on delivery location unless a valid tax-exemption certificate is provided at purchase.

8. Errors & Omissions
Company reserves the right to correct typographical or technical errors and to cancel orders based on incorrect information.

9. Warranty & Liability
   •    Company warrants workmanship for 1 year from delivery, excluding damage from misuse, ordinary wear, or inherent variation.
   •    Customer must report defects within 7 days to be eligible for repair or replacement.
   •    Liability is limited to repair or replacement; indirect or consequential damages are excluded.

10. Intellectual Property & Media
Company retains ownership of molds, drawings, templates, and designs. Company may use project photographs for marketing unless Customer opts out in writing.

11. Confidentiality
Both parties shall maintain confidentiality of proprietary, non-public information shared during the project.

12. Limitation of Liability
Company is not liable for indirect, incidental, or consequential damages. Customer’s sole remedy is repair or replacement within the warranty period.

13. Force Majeure
Company is excused from performance due to events beyond control—natural disasters, strikes, supply chain disruptions, epidemics, or acts of government.

14. Governing Law & Dispute Resolution
These terms are governed by the laws of New Jersey. Any dispute shall be resolved in the courts of Passaic County, and Customer consents to this jurisdiction.

15. Disclaimer
By accepting and installing the product, Customer assumes all risk of improper handling, misuse, or accidents arising thereafter.
